Abstract

The International Law Framework on Human Rights and Freedoms provides opportunities to limit certain human rights in emergencies, especially when it comes to protecting human health. The outbreak of the pandemy with the Covid-19 virus worldwide is one of the reasons that can lead to violation of the Human Rights and Freedoms, which are part of the democratic society.
Some restrictive measures adopted by EU member states may be justified on the basis of the usual provisions of the European Convention on Human Rights concerning the protection of health, however, for exceptional measures it may require derogation of laws regarding the obligations of states under the Convention. Article 15 of the European Convention on Human Rights provides the possibility for derogation for certain obligations arising from the Convention for a specified period of time and under certain conditions, i.e. if there is a "state of emergency", war or other general danger that endangers the lives of citizens.
This paper will analyze the situation in the Republic of N. Macedonia as a consequence of Covid 19 in terms of restricting human rights, according to the European Convention on Human Rights.
