Abstract

The juvenile justice system is a subject of a debate in numerous international documents that indicate directions and standard rules. It is not in their nature to set strict imperative and prohibitive regulations, whereas to define certain minimum standards that influence the criminal policy of the state and the selection of the most appropriate penal solutions that in the best possible way reflect the goals they proclaim. This paper contains analysis of the legal position of the child offenders and the proceedings in the competent institutions in the Republic of Macedonia, comparison of the solutions in the Macedonian legal system to the references in the international documents and last but not the least, determination of the degree of harmonization with the United Nations Standard Minimum Rules, often referred to as the Beijing Rules.
