Abstract
The doctoral dissertation deals with, in its essence, a complex and unique legal, but also political notion: the optant property. By its nature, unique, both in legal terms and in the context of international politics. Inaugurated as a legal notion, gradually, and in several stages, the author experiences its evolution over a period of thirty years. From the end of World War II in 1945, until the formal act of signing of the Osimo Accods (a bilateral treaty between Italy and the former SFRY) in late 1975.
The paper draws a parallel between the situation in Istria (after the end of the Second World War), on the one hand, and the situation in the northern part of Greece, in terms of property rights, i.e. the status of citizens of different ethnicity. The commitment and the predetermined goal and message of the author of the work is of civilized nature/character: the right to property be treated as a universal right that is guaranteed to all citizens, regardless of affiliation to certain countries or differences in social order.
The author offers a solution to the question on how the Osim Accords can be used as a comparative example and applied to overcome the open question of the property of ethnic Macedonians in northern Greece, despite the undoubted historical distance and other obvious differences in the two examples
