Abstract

Lex voluntatis is a dominant choice of law doctrine, that allows the parties in
international contracts to choose the applicable law of particular state they prefer. The
concept of lex voluntatis is not determinied in absolute terms. Contrary, this core
principle in private international law is limited by mandatory, protetctive mandatory
and internationally mandatory rules.
The subject of this paper is a comparative analysis of the party autonomy in the law
and jurisprudence of the European Union and the Republic of Macedonia, with a
particular focus on international consumer contracts. For the purposes for this paper
the method of normative analysis, historical method and the method of induction and
deduction will be applied.
