Individuals’ efforts to find a better life conditions by migrating from one to another area, in some cases causes unwanted, sometimes dramatic and drastic changes, both individually and within smaller social groups, but also at the level of wider community, and even on international level. But often, people’s needs, desires and possibilities do not coincide. Among other things, there are many obstacles in the path of migrant movement, such as the legal interests of states to regulate their borders crossing, transit and alien residence. At the same time with states legal regulations, there are international and national legal solutions that are sanctioning any activities directed towards smuggling of migrants. Such normative solutions whose goal is to prevent and suppress the connection between criminals and migration have been adopted by the Republic of Serbia and the Republic of Macedonia. In addition to the legal solutions presented in international documents that indicate the necessity of incriminating criminal activities in context of migration, ratified by both countries, we will point out the common characteristics of their criminal legal response, but also the certain differences, and deviations, in relation to international legal documents. The paper contributes in direction of improvement of existing normative foundations of smuggling of migrants’ legal solutions.
