Imprisonment as a punishment has been known to society since its first organized forms. And just as social forms have been and still are changing, the punishment changed its structure and philosophy, with prisoners’ position climbing up from repressed criminals to humans in need of resocialization and treatment. This evolving process had its other parallel processes, with different penitentiary systems and modifications in prisoners’ human rights. Namely, from cell systems and no human rights for incarcerated prisoners, today’s modern penitentiary systems must guarantee prisoners’ human rights and enable a successful penal treatment. But is every modern society fulfilling the resocialization’s expectations? The paper will analyze the nexus penitentiary system – resocialization – human rights, with a special focus to a comparative overview of this connection in three modern, but different (in resocialization outcomes) penitentiary systems.
