Abstract
The rule of law and the fight against corruption are foundational to the functioning of democratic societies. This paper examines the rule of law as a conditio sine qua non — an essential element — for effective anti-corruption efforts and how the rule of law and security are intrinsically linked, with each reinforcing the other. Systemic corruption depends on the existence of a culture of impunity. The fight against impunity is a fight for human rights and is a struggle for a life of dignity. A robust rule of law provides the framework for a secure society by ensuring accountability and protection of human rights. It argues that without a consistent and impartial legal framework, initiatives to combat corruption lack legitimacy and enforcement power. It analyses how the erosion of the rule of law facilitates impunity, weakens institutions, and undermines public trust, thereby creating fertile ground for systemic corruption. Through a comparative analysis of international legal instruments, case studies, and empirical research, the paper argues that restoring and strengthening the rule of law must be central to any credible anti-corruption strategy, focusing on the fundamentals: rule of law, democratic standards, legal frameworks, institutions, capacity building, and good governance.
