Abstract

It is a fact that administrative supervision and control of actual administrative acts cannot ensure
sufficient extent of abiding the principle of legality by the administration, and even less
guarantee the protection of individual rights and freedoms against irregular procedures of the
administrative bodies.
Therefore the solution related to evaluation of legality of administrative acts to be entrusted to
the courts as autonomous and independent state authorities is unacceptable.
Jurisdictions of a court (administrative or ordinary) in terms of making decision on legality of a
particular state act are however different.
Exactly these jurisdictions of administrative judiciary in the Republic of Macedonia are subject
to my study and objective therefore will be to assess whether those jurisdictions correspondent to
the function of the court in our society in compliance with its set-up with the legal regulations.
In the Republic of Macedonia the administrative disputes are divided as follows: disputes on
legality of administrative acts and disputes on complete jurisdiction1. The division is made by the
different extent of jurisdiction possessed by a court when making decision on the legality of
administrative acts and decision adopted thereof.
