Abstract

Subject: The subject of this paper is the application of the principle of publicity in Macedonian procedural law, through a normative analysis, in particular, the Law on Litigation Procedure, the Law on Non-contentious Procedure, the Law on Criminal Procedure, and the Law on Administrative Disputes. Method: The study of this paper's subject will be primarily realized by applying the method of normative analysis, as well as the methods of comparison, analogy, and case law method. Aim: This paper aims to give an overview of the Macedonian legislation regarding the application of the principle of publicity in the above-mentioned court proceedings, as one of the most important principles that reflect the principle of just and fair trial in modern democratic states. Conclusion: In the paper's conclusion, we will try to provide recommendations and guidelines for a more effective application of the principle of publicity, having in mind the practice of the European Court of Human Rights.
