Abstract

Republic of Macedonia in 1995 became the 38th member State of the Council of Europe, and two years later the Macedonian Assembly adopted the Law on Ratification of the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment and the Protocols No. 1 and No. 2 to the said Convention. By signing and ratifying the Convention, Republic of Macedonia agreed that the protection of persons deprived of their liberty against torture and inhuman or degrading treatment or punishment could be strengthened by non-judicial means of a preventive character based on visits, which implies that Republic of Macedonia gave consent to permit visits, carried out by the members of the Committee, to any place within its jurisdiction where persons are deprived of their liberty by a public authority. Having in mind the above, the main task of the Paper is to give an answer to the question whether the Republic of Macedonia has fulfilled its obligations set by the Convention. However, it must be pointed out that the Paper shall limit its research only to the Ministry of Internal Affairs, or to be more precise - to the facts found during Committee’s visits, its recommendations and suggestions for improvements in the protection of persons deprived of their liberty by this law enforcement agency. If the purpose of the Committee’s visits is taken into account, i.e. not to condemn or to criticize the Contracting Party, but rather to act in a preventing manner with a view of strengthening the protection of the rights of persons deprived of their liberty, the Paper shall provide an overview what has Republic of Macedonia achieved 20 years after its ratification of the Convention.
