Abstract

According to the Universal Declaration of Human Rights of 1948, the right to asylum1 is one of the fundamental human rights. States recognize the right of asylum to persons in accordance with the principle of discretion, if there is a real risk of persecution in their countries of origin because of their affiliation to race, religion, nationality, membership of a particular social group, or political affiliation. Persons, who receive an international protection, actually obtain legal status in the country of asylum i.e. acquire certain rights and obligations. The subject of this paper is to scrutinize the right to asylum. The paper consists of an introduction, three parts and a conclusion. It begins by presenting the theoretical definitions of the right to asylum incorporated in the national legal systems and in the legislative of the international organizations. In the first part, the legal framework for asylum in the European Union is analyzed, while in the second part, the legal and institutional framework for asylum in the Republic of Macedonia is considered. The third part includes an empirical data on asylum, published by the competent authorities, as well as certain assessments and recommendations regarding that empirical data.
