Abstract

Autonomous, independent and impartial judiciary and institutions that will help in the achievement of a quality and equitable right creation is the foundation of the rule of law principle in the Republic of Macedonia. The improvement of the judicial system and its functioning is one of the basic assumptions for the functioning of the legal state in terms of respecting the right to equality in the freedoms and rights of citizens. In order to perceive the situation in this sphere and contribute to their promotion, this paper aims to elaborate the current situation from the aspect of the legal framework in the country in the field of justice (judiciary), but also to the institutions that assist in its functioning (advocacy, prosecution, attorney's office, execution, notary, mediation, etc.). We will also point out some of the challenges that the state faces in this area and propose reforms that will contribute to overcoming the problematic situation in accordance with the analysis of the data obtained in the survey of the concerned instances. We will try with argued conclusions to give directions for improvement of the justice system in the country, to give directions for overcoming the existing deficiencies of a normative and institutional character. The ultimate goal of the paper is to contribute to the creation of an independent, impartial, quality and transparent judiciary in the state, based on the protection of individual freedoms and rights of citizens and the existence of responsible judicial authorities in all aspects of their work.
