Abstract

The big mobility of the citizens and the capital in our country also, especially at the beginning of the 21st century, had an influence in establishing a significant number of legal relations requiring secure and solid legal framework for its regularization, i.e. for solving the disputes which involve a foreign element. Today there is almost no legal area where a foreign element isn’t involved in any form possible. These relationsoften generate a commencement of a legal (criminal and civil proceedings) and other procedures (administrative andinfringement proceedings)for whose solving a cooperation between ours and foreign legal and other entities would be necessary , which imposes the need of establishing a legal mechanism that provides a legal protection to all parties in the proceeding. The international legal cooperation in the criminal matter in the last decades gets new dimensions with a significant increase of the requests for a mutual cooperation between the countries. The reason for this is the expansion of the criminal acts with a foreign element, which imposes the need of reformation of the Criminal law in Republic of Macedonia. By these reforms the country confirms its intention to adopt the process of unification of the national with the European legislation. Following these conditions for achievement of the citizens’ and other legal entities’ interests, this paper intends to review the latest issues in the international legal cooperation in view of the national, bilateral and multilateral legislation, detecting the weaknesses in its functioning and finding compatible solutions that shall be most efficient for achieving an international legal trade.
