Abstract

The main purpose of this article is to contribute to the continuing debate on whether states respect the human rights and fundamental freedoms of people and the existence of equality of nations in international law. This will be done through a theoretical exposition placing this perspective in the spectrum of the main theories on the same topic, with special reference to international relation between countries and reference to some foundational treaties of international organizations. We live in an era where virtually every government in the world claims that they pay allegiance to human rights and respect for international law. Does the recognition of human rights in international law undermine the traditional conception of international society as a society of sovereign states?This article will examine briefly the identity politics and the self-determination as a core principle of international law and analyze the prospect of negotiated dispute agreements and the national interest from a paradigmatic point of view.
