Abstract

Abstract: The subject of this paper is the presentation of the system, the procedure and the conditions for recognition and enforcement of foreign court judgement in the law of the Republic of North Macedonia and in the European Union Law, through a normative analysis of the Macedonian Act on Private International Law, the Regulation (EU) No 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (recast), as well as the Hague Convention on the Recognition and Enforcement of Foreign Judgments in Civil and Commercial Matters. The study of this subject matter will be primarily conducted by applying the normative analysis method, as well as the methods of comparison, analogy, induction and deduction, and the case law method. The aim of this paper is to provide a comparative overview of the systems for recognition and enforcement of foreign court judgment envisaged in Macedonian law and EU law, as well as to give an answer to the question to what extent the Macedonian system is harmonized with the EU’s system in this very important judiciary segment. In conclusion, the author provides some recommendations and guidelines for amending the Macedonian legislation in the segment of the recognition and enforcement of foreign court judgment for the purpose of its harmonization with the European Union Law.Keyword: recognition, enforcement, foreign judgements, PIL, Macedonian law, EU law.
