Abstract

The roots of surrogacy in traditional terms appeared in the 1970s as a phenomenon of newspapers‘ ads where males with infertile wives were looking for young women who would accept to give birth to their children for a financial benefit. Years later, after the development of modern medicine, gestational surrogacy was the more often used kind of this phenomenon. The interest around this topic resulted with different opinions regarding its justification and it was connected and compared to prostitution, trafficking in children and other social and criminal phenomena. The Republic of Macedonia accepted the benefit of altruist gestational surrogacy in 2014 with the amendments to the Law on Biomedical Aided Fertilization. By using the normative and comparative method, this paper will analyze the legal situation with surrogacy in the Republic of Macedonia and other countries, but will also review some of the most notable philosophical directions and opinions. Key words: altruism, commercialism, feminism, Republic of Macedonia, surrogacy.
